Today there are over forty different standards (CFR 29 part 1926 & 1910) that require some type of employer training within the Commercial and/or Home Industry Construction Industry. Granted some are construction industry specific, and do not comply to all contractors while others are critical and require written training for compliance.
At Catalyst Connections, Inc. we recognize that, whether the builder or contractor is large or small, they are still at risk for fines and violations caused by both their employees and the lack of safety practices of their sub-contractors.
We recognize that there are some builders that still feel “OSHA won’t come to my job site” or “ I don’t have employees so I won’t get fined” . . . wrong answers. Under Federal and State guidelines the responsibilities still fall to the general contractor and the fines are real for non-compliance. As a business and safety consulting firm, we specialize in safety compliance challenges within the construction industry.
To assist organizations in minimizing their exposure to unnecessary OSHA fines and penalties we assist them in conducting a safety diagnosis of their current safety programs, work site practices and recordkeeping. Penalty/Fine Appeal Assistance
It is unfortunate when contractors receive citations for non-compliance safety practices on their job sites. What is more disturbing is when these citations are generated by sub-contactor non-compliance. Today it is not only the initial fine assisted for the violation, it is the fact that future violations in the same areas may be viewed as repeated and willful and bring future fine levels as high as “7-times” or seven thousand dollars.
At the end of every OSHA job site inspection; there is a closing conference that will outline specific non-compliance issues that need builder attention immediately. However, what do you do to minimize your fines and penalties, write the appeal within the deadline time and how do you develop the necessary strategy to present at your informal hearing? The strategy is key and the written appeal with attachments may be part of your strategy to reduce fines or shift citation focus.

Safety Programming
Today it is not only critical to have a proactive approach to the safety and health of your employees but it is equally important to focus on the safety surroundings within your job site. Whether you are a large contactor with employees or a small contractor that only has subcontracted labor, you are still responsible for the safety and health of all workers on your job sites. Sure there are exceptions and even OSHA memorandums in field inspector manuals that define limits to contactor exposure, but the buck stops with you and the fines and penalties are passed on.

THE HIRING & SELECTION Option
This section gives a business the legal side of hiring by educating them on the federal laws and regulations that effect the hiring process. It discusses not only the do’s and don’ts of asking questions, but also contains over six pages of behavioral interview questions that keep your interview focused on matching the candidates with the job requirements.
This section also explores the five critical parts of the hiring process and how to maximize leadership effectiveness in the hiring process. Sample employment applications, telephone interviewing forms, reference check forms, interview (interpersonal skills) check lists are some of the forms included on CD-ROM for duplication. This is a must in management effectiveness.

WORKERS COMP LOSS CONTROL Option
The success of loss prevention under workers’ compensation depends on an effective lost prevention management program, the working relationship with employees, local medical providers and the insurance carrier. This joint effort between all parties will provide your organization with the sound and necessary program focused on continued open communications which all have the goal of a speedy recovery of any injured employee.
Although most employers depend totally upon the Workers Compensation Carrier to handle post injury claims, it is critical that employers remain pro-actively involved with the process. As an employer you must realize that your workers’ compensation carrier is paid by you but true interest in your company and minimizing WC loss control & exposure still remains with you.
This section, give a business a strong focus on minimizing their exposure to unnecessary workers compensation expenses due to employee injuries and legal settlements along with the necessary forms and processes. Within this section:

This section allows you to make choices on whether to drug test or not within your organization. It covers the types of testing and
provides you with the written policy documentation required for your state. This section also communicates the local agencies that
have a (MRO) medical review officer available to collect and read test results for your company.

COMMUNICATING NEEDED CHANGE / DEALING WITH DISCIPLINE
Dealing with discipline or performance / work habit issues can be a stressful experience for even the best of managers, but it goes
beyond this in every organization. The need for IMPROVEMENT and Performance results remains the key.

The Company Safety Philosophy part of the safety manual is a key area that sets the company’s safety values. This area discusses not only what the company’s safety goals are but also what performance expectations they expect from employees and subcontractors working on their projects. This is a critical part of any and all safety programs and is supplied in both English and Spanish. This statement is signed by the Company president.
The Safety Responsibilities section of the safety manual outlines the basic principles of safety and the responsibilities or roles of management, the sub-contractor and the employees with specific performance expectations. Each role is vitally important to the success of the company’s safety program and is supplied on separate sheets in both English and Spanish.
The New Hire Orientation section of the safety manual has been developed to ensure that all employees are given the necessary safety training that covers both the Company’s safety policies and various general safety training subjects that are required under OSHA standards 1910 & 1926. Included in this section are facilitator guidelines to ensure each topic is discussed and a safe work practices handout sheet for all employees. A training documentation sheet is also included. The topics include not only the company safety policies and guidelines but also; PPE, Ergonomic Safety, Office Safety, Power /hand tools, Electrical Safety, Fire/Medical procedures, Safety talks, CPR & Choking. Employee handouts are supplied in both English and Spanish.
The Company Safety Rules section of the safety manual has been developed to ensure that all employees and sub-contractor employees are given the necessary safety standards to follow when working on company property or a company project site. These safety rules cover the various safety situations on the job but it does mention that they are not all inclusive and that the other OSHA safety standards do apply to all workers. These company rules do note that employee disregard or failure to follow the safety rules may be grounds for progressive disciplinary action (following current client procedures). This section is supplied in both English and Spanish.
The Accident Management /Reports section of the safety manual has been developed to give clear guidelines in case of an employee accident/injury. This section discusses the accident reports to your workers compensation insurance carrier, the OSHA form 300 reporting requirements, and proper techniques to investigate an accident. This section also gives you local emergency phone numbers including your insurance carrier, company office and various local hospitals. A new copy of the Accident / Incident Investigation form is included.
The Workers Compensation / Los Control section of the safety manual has been developed to ensure a pro-active approach remains on workers compensation and the processing of accidents and injuries that may occur. The importance of a strong relationship with the insurance carrier, medical provider and the injured employee is stressed. This section contains information on insurance fraud and how to identify it.
The OSHA section of the safety manual has been developed with each employer in mind to transfer knowledge that they normally would not have at their finger tips. The first part of this section discusses OSHA’s philosophy on their inspection process. This also includes the MOSH guidelines as listed in their Inspectors Field Manual. The second part is also taken from a current MOSH memorandum outlining the inspectors determination (various examples) of who shall be fined on multi-employer job sites. The third part deals with the OSHA inspection, including an overview on what to expect during a OSHA site inspection by their Field Inspector. This includes both the builder’s responsibilities and your rights as a builder if you are cited. The final part of this section discusses the OSHA Form 300 and the details surrounding the record keeping and posting requirements. Samples of the forms are included.
The Safety Enforcement and Compliance section of the safety manual has been developed to educate your employees on the “how to” and the “what to” in job site inspections for OSHA compliance. After a recap of the importance in job site inspections, it details a step-by-step process in conducting a site safety inspection. The process not only discusses what to look for but also what visual process must take place when you complete an inspection report. This section includes a formal safety inspection form containing 24 separate focus areas that are referenced to OSHA standards. Each area contains several sub areas to watch for non-compliance issues. It also contains an inspection report recap sheet and a Violation notice form.
As a proactive employer focusing on the safety of its workers it is critical to do occasional documented safety inspections of your job sites.
The Emergency Preparedness section of the safety manual has been developed to ensure that all employees are trained in the essentials of medical / fire prevention and emergency response. The education of this section is an important area for OSHA compliance. An employee safe work practices handout sheet is included. This section also not only tells employees where medical first aid equipment and fire extinguishers are located on the job site, but also begin to discuss the importance of knowing the hazardous chemicals that may be present within their work area. This section also includes an Emergency Information Posting that includes your local emergency phone numbers.
The Job Site MSDS (Material Safety Data Sheets) section of the safety manual is an important section of the manual. Each contractor is responsible to know the various hazardous materials that are present on each job site. These chemicals or material can be brought on by either their own employees or the various subcontractors. This section contains forms to collect and record such information. Each employer is also required to train their employees in specific MSDS identification which is covered under a specific training segment under a separate section of the manual. Although many State OSHA programs vary, some also require the employer to document and submit their hazards material list to their State Environmental agency; as does Maryland. This section will contain those forms if it applies.
The Construction Training Requirements section of the safety manual has been developed to ensure that all employers and sub-contractors are aware of the various employee training requirements associated with the Construction Industry. These requirements reference the various OSHA standards from Title 29 code of Federal Regulations Parts 1910 & 1926. Although not all the requirements may relate to your specific construction focus, they are listed in reference, as a check list, to share with all sub-contractors that will work on your project site.
This area is also included in the sub-contractor standards packet.
The Training Your Employees section of the safety manual has been developed to give the company’s safety trainers additional tools in developing and presenting effective safety training. Although this program manual contains specific training subject matter and facilitator guides to maximize the training process, this section will enhance the trainer’s skill level. The OSHA training model or guidelines are discussed and expanded to give each trainer the tools necessary to develop present and review program effectiveness. It covers not only identifying training needs but also covers the steps in developing proper learning activities and strengthening participant motivation.
The Safety Training Program (safety talks) section of the safety manual has been developed to focus in on the more critical safety training requirement under the OSHA standard. Within this section there are over 140 pages dedicated to eleven specific training topics. Each topic has facilitator notes, topic information / examples, employee handouts and the necessary training documentation sheet. Within this section there are also written Safety Programs on Fall Protection, PPE MSDS that meet the requirements of the standard. The Fall Protection program has both a commercial and residential construction written fall protection plan within it. The Sub-Contractor Standards Packet section of the safety manual has been developed to focus on reinforcing the goal to minimize the contractor’s exposure to sub-contractor non-compliance of safety regulations and standards. This section contains five separate documents that should be given to every sub-contractor performing work for the contractor. The first document is a sub-contractor Safety Agreement that outlines their responsibility toward complying with all OSHA and State Safety Regulations and Standards. This agreement also indicates each of the contractor’s safety documentation they are given and must comply with.
Each contractor is given 1) Company’s Safety Rules 2) Copy of Safety Role of Sub-Contractors 3) Construction Training Requirements overview sheet 4) Contractors Job Site Safety Inspection Report which they will be held responsible to adhere to. This packet has been developed to accompany any other “signed” sub-contractor agreements..
